Mental Capacity Act and Deprivation of Liberty Safeguards (DoLS)

The Mental Capacity Act 2005 affects everyone working with and/or caring for an adult who may lack capacity to make specific decisions. They must comply with this Act when making decisions or acting for that person, when the person lacks the capacity to make a particular decision for themselves. The same rules apply whether the decisions are life-changing events or every day matters. The Deprivation of Liberty Safeguards (DoLS), are an amendment to the Mental Capacity Act 2005, giving clarity to how restraint and restrictions that amount to a deprivation of liberty can be applied to individuals lacking capacity.

Our training aims to improve understanding of the Mental Capacity Act 2005 and its Code of Practice including DoLs. You will gain guidance and information about how the Act works in practice. All those who act in a professional role for, or in relation to a person who lacks capacity, have a legal duty to follow the guidance in the code.

It is important to have up to date training and an annual refresher. Our training is mapped to Care Certificate Standard 9.6 – Understand the meaning of mental capacity in relation to how care is provided.

Course Outline


  • To provide good working practice on a day to day basis when working with people who lack capacity to make decisions for themselves.


By the end of this course you will :

  • gain an understanding of what the Mental Capacity Act 2005 is about
  • understand your role and responsibilities when decisions need to be made
  • receive guidance regarding using/implementing the Mental Capacity Act 2005
  • gain an understanding of Deprivation of Liberty Safeguards (DoLS)
  • receive guidance regarding DoLS

Half day courses are £40 per person or £375 for a group of 12 learners (maximum)
